Samsung Korea Consortium Contract

  1. The Contract clearly states in section 14.1[1] an end date of December 31, 2017. It is the same statement in the January 21, 2010 Agreement, including the same section.
  1. Was the agreement re-negotiated because Samsung-Korea Consortium could not fulfill its obligations for all 5 phases replacing it with merely 3 phases or was it re-negotiated because of the World Trade Court’s ruling in 2013?[2]
  1. If Samsung – Korea could not fulfill their obligations under the original agreement why would the province enter into a second agreement with an entity from less than the original agreement if the one party couldn’t fulfill its obligations under the first agreement?
  1. There are statements of a 20 year agreement (the consortium shall operate the facilities for a period of 20 years) [3] between the province and Samsung-Korea (KEPCO) and yet KEPCO, according to the Ministry’s web-site has been released from the agreement and its obligations are to be fulfilled by Samsung,[4] who released KEPCO from the agreement and why wasn’t the people of Ontario informed of this change to the contracting parties, and what about the end date specifically stated in the amended and restated Green Energy Investment Agreement between Her Majesty the Queen (Minister of Energy) and the Korea Electric Power Corporation and Samsung (Korea Consortium) on June 20, 2013?
